# SpaceCode Terms of Service

1. Early access. SpaceCode is early-access software provided "as is" and "as available", without warranties. Features, limits and availability may change or stop at any time.

2. Accounts and keys. Keep your API key secret; you are responsible for activity under it. Access is by invitation or sign-up while capacity lasts and may be limited or suspended.

3. Your code. You keep all rights in your code, prompts and outputs. You grant us a limited licence to process them solely to run the service (including sending them to AI model providers). You must have the right to submit any code you use with SpaceCode.

4. AI output. Output may be wrong, insecure or infringing. You are responsible for reviewing it before use. The agent can run commands and modify files; run it only on code and machines you accept that risk for.

5. Sandboxes are ephemeral. Sandbox contents are destroyed on disconnect. Git-safety attempts to commit and push first, but can fail; do not rely on a sandbox for storage.

6. Acceptable use. No illegal use, malware, attacks or scanning of third parties, crypto mining, circumventing limits, reselling access, or abusing shared capacity. We may throttle, suspend or terminate for abuse.

7. Limits and fees. Daily request/launch limits apply. Paid plans, if introduced, will be priced before you are charged.

8. Third parties. Model providers, GitHub and others have their own terms.

9. Liability. To the maximum extent permitted by law, we are not liable for indirect or consequential loss, lost data or profits; total liability is capped at the greater of fees paid in the last 12 months or USD 50.

10. Termination, changes, law. Either party may end use at any time. We may update these terms and will post the date. Governing law: State of Delaware, USA; venue: state and federal courts located in Delaware.
